Terms & Conditions

These Terms & Conditions govern your use of panchhiinfotech.com and all services provided by Panchhi Infotech (“we”, “us”, “our”), a business owned by Dharakumari Jigneshbhai Akbari, GSTIN 24BVNPA8907R1ZX, located in Surat, Gujarat, India. Please read them carefully before using our website or hiring us.

1. Acceptance of terms

By using this website, sending us an enquiry, approving a quote, or making a payment, you (“Client”, “you”) agree to these Terms. If a separate written agreement or signed proposal exists for your project, that agreement will apply first, and these Terms will apply to everything it does not cover.

2. Our services

We provide IT services including, but not limited to:

• Website design and development, e-commerce and web applications
• Android, iOS and cross-platform mobile app development
• Custom software, CRM, ERP, billing and automation systems
• Digital marketing, SEO, paid ads and social media management
• Hosting setup, maintenance and technical support

3. Quotes, proposals & scope

• Every project starts with a written quote or proposal that lists the scope, features, timeline and cost.
• Quotes are valid for 30 days from the date of issue unless stated otherwise.
• Only the work clearly listed in the approved proposal is included. Anything else is treated as additional work.
• All prices are in Indian Rupees (INR) and are exclusive of GST, which will be charged as applicable.

4. Payment terms

• Unless the proposal says otherwise, an advance of 50% is required to start the project, and the remaining balance is due before the final delivery, launch or handover.
• Larger projects may be billed in milestones as mentioned in the proposal.
• Invoices must be paid within 7 days of the invoice date.
• If payment is delayed, we may pause work, delay delivery or suspend services (including hosting or support managed by us) until the dues are cleared.
• Monthly services such as maintenance, SEO or social media management are billed in advance for each month.
• Payments can be made by bank transfer, UPI or any other method we confirm in writing.

5. Timelines & client responsibilities

We will do our best to deliver on the agreed timeline. Timelines depend on you providing content, images, logins, approvals and feedback on time. You agree to:

• Share all required content and materials in the agreed format
• Give feedback and approvals within a reasonable time (usually within 5 working days)
• Make sure any content you provide is legal and that you have the right to use it
• Name one point of contact for the project

Delays caused by missing content or late feedback will extend the timeline. If a project stays on hold from your side for more than 30 days, we may close it and invoice the work completed so far.

6. Revisions & change requests

Each project includes the number of revision rounds mentioned in the proposal. Requests for new features, design changes after approval, or work outside the agreed scope will be quoted separately and may change the timeline.

7. Third-party services & costs

Domains, hosting, SSL certificates, premium themes or plugins, app store developer accounts, SMS or email services, payment gateways and advertising budgets are paid to third parties and are not included in our fees unless clearly mentioned. These services are governed by the terms of their providers, and we are not responsible for their downtime, policy changes or price changes.

8. Intellectual property

• After full and final payment, ownership of the final design and custom code made specifically for your project is transferred to you.
• Until full payment is received, all work remains the property of Panchhi Infotech.
• Open-source software, third-party libraries, licensed assets and our own reusable tools or frameworks remain the property of their respective owners and are provided under their licences.
• Unless you ask us not to in writing, we may show the finished project in our portfolio and include a small “Designed & developed by Panchhi Infotech” credit.

9. Digital marketing & SEO

Search engine rankings, traffic, leads and sales depend on many factors outside our control, such as search engine algorithms, competition and market conditions. We follow ethical, proven practices, but we do not guarantee any specific ranking, position or result. Ad spend is paid directly to the advertising platform and is non-refundable.

10. Warranty, support & maintenance

• We provide free bug fixing for 30 days after launch for issues in the work we delivered.
• This free support does not cover new features, content changes, or problems caused by changes made by you or anyone else, third-party updates, hosting issues or misuse.
• After this period, ongoing support and maintenance are available through a paid plan.
• Please keep backups of your own data. While we take care, we are not responsible for data loss on servers or services not managed by us.

11. Confidentiality

We treat all business information, data and login details you share with us as confidential and use them only for your project. We will not share them with anyone except team members who need them to do the work. You also agree to keep our proposals, pricing and internal methods confidential. How we handle personal data is explained in our Privacy Policy.

12. Cancellation & refunds

• You may cancel a project by informing us in writing.
• The advance payment is non-refundable once work has started, as it covers planning, resources and time already committed.
• On cancellation, you will be billed for the work completed up to that date. Any amount paid above the value of completed work may be refunded at our discretion.
• Monthly services can be cancelled with 15 days' written notice before the next billing cycle. Fees already paid for the current month are not refunded.
• We may end a project if these Terms are seriously broken, payments are not made, or the work requested is illegal or unethical.

13. Limitation of liability

We work with care and skill, but our services are provided on an “as is” basis beyond the warranty mentioned above. To the extent allowed by law, Panchhi Infotech will not be liable for any indirect, incidental or consequential loss, including loss of profit, revenue, data or business. Our total liability for any claim related to a project will not be more than the amount you paid us for that project.

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, power or internet outages, server failures of third-party providers or government actions.

14. Use of this website

The content on this website, including text, graphics, logos and design, belongs to Panchhi Infotech and may not be copied or reused without our written permission. You agree not to misuse the website, try to gain unauthorised access, or submit false or harmful information through our forms. We may update the website content and these Terms at any time; the latest version will be posted on this page.

15. Governing law & disputes

These Terms are governed by the laws of India. We will first try to settle any dispute through friendly discussion. If it cannot be resolved, the courts of Surat, Gujarat will have exclusive jurisdiction.
